Terms & Conditions

This English version is a convenience translation. The German version of these Terms and Conditions is the sole legally binding version. In the event of any discrepancy between the two, the German text prevails. The German version is available at omclub.de/agb.

1. Scope

These General Terms and Conditions apply to participation in the "OMClub" event and to all related services of PIRATEx GmbH (hereinafter the "Organizer"), including bookings by sponsors and hosts. The Organizer is registered in the Commercial Register of the Cologne District Court under HRB 91279. Full provider details are available in the imprint. Conflicting terms of the contractual partner do not become part of the contract, even if the Organizer does not expressly object to them.

2. Eligibility

Participation in the OMClub is only permitted for persons who have completed their 18th year of age. The Organizer reserves the right to carry out identity checks.

3. Ticket Allocation (Robin Hood Principle)

Tickets for the OMClub are not available for purchase. They are allocated exclusively through sponsor codes, competitions or special promotions. There is no legal claim to a ticket.

4. Sponsor and Host Bookings, Conclusion of Contract

Sponsors and hosts receive an offer from the Organizer in text form, by email, letter or through the ticketing or booking provider in use. This offer is binding and describes the services owed by both parties. The contract is concluded upon acceptance by the contractual partner, in particular through the booking. A booking is binding once it is confirmed. Later changes to the type or scope of the services require the consent of both parties. Additional services are to be remunerated appropriately.

5. Payment, Cancellation and Refunds

Bookings for the OMClub are binding and are not refundable. A cancellation after conclusion of the contract does not release the contractual partner from the obligation to pay. Unless otherwise agreed, invoiced amounts are due within 14 days of receipt of the invoice. In the event of default, the Organizer may charge default interest of nine percentage points above the base rate pursuant to Section 288 (2) of the German Civil Code (BGB).

6. Right of Admission

Despite a valid ticket, the Organizer reserves the right to refuse entry to the event for good cause (e.g. overcrowding of the location, heavy drinking or aggressive behavior).

7. Image and Sound Recordings

By participating in the event, the guest agrees that image and sound recordings may be made of them and used indefinitely and without spatial restriction for reporting purposes and marketing (social media, website, aftermovie). The privacy policy applies in all other respects.

8. Travel and Accommodation

The Organizer does not cover the cost of travel to and from the event or of accommodation, unless this has been expressly promised in writing.

9. Liability

The Organizer is only liable for damage caused by intentional or grossly negligent breach of duty. No liability is assumed for items brought in (cloakroom etc.). The Organizer is not liable for the cancellation, postponement or alteration of the event due to force majeure or other circumstances beyond its control (e.g. war, fire, strike, extreme weather, official order). Speakers and program items may change at short notice.

10. Program Changes

The Organizer reserves the right to change the program or individual program items at short notice if this is necessary and the overall character of the event is maintained.

11. House Rules

The house rules of the respective venue must be strictly observed by all guests.

12. Termination and Withdrawal

For good cause, both the Organizer and the contractual partner may terminate or withdraw from the contract. Good cause exists in particular in the event of a breach of a material contractual duty. The right of termination does not affect the obligation to pay for services that have already been booked on a binding basis.

13. Applicable Law and Place of Jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction is Cologne, provided the contractual partner is a merchant, a legal entity under public law or a special fund under public law. The German version of these Terms and Conditions is the legally binding version.

14. Severability

Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The parties shall replace the invalid provision with a valid one that most closely reflects its economic purpose.

15. Changes to These Terms

The Organizer may amend these Terms and Conditions at any time. Changes will be published on the website. For contracts already concluded, the version valid at the time the contract was concluded applies.
